Wake Boat Demo Liability Waiver & Release Form

1. Activity description

The undersigned desires to participate in wake boat charter activities provided by Wake Bros LLC, including but not limited to:

• Wake surfing instruction
• Boat transportation and cruising
• Use of provided recreational equipment (surfboards, ropes, life vests, etc.)

Wake Bros LLC charters include an experienced captain and most necessary gear. We do not provide food, alcohol, or infant-sized life vests. Guests are responsible for bringing their own suitable infant PFDs, snacks, and beverages.

2. Assumption of risk

I acknowledge that boating and water sports are inherently dangerous activities that carry the risk of serious injury or death. These risks include, but are not limited to:

• Drowning or impact injuries from equipment, water, or boat
• Injuries due to falls, collisions, or contact with other participants
• Risks caused by equipment failure, weather, or water conditions

I voluntarily choose to participate, understanding and accepting these risks.

3. Waiver and release of liability

In consideration of being allowed to participate, I hereby voluntarily release, waive, and discharge Wake Bros LLC, its owners, officers, employees, agents, and affiliated parties from any and all liability, claims, demands, or causes of action arising from or related to:

• Personal injury, illness, or death
• Damage to or loss of personal property
• Negligence of Wake Bros LLC or its agents (excluding gross negligence or intentional misconduct)

4. Equipment use and responsibility

• I agree to use all equipment in a safe and responsible manner
• I will wear a U.S. Coast Guard-approved life vest at all times while on or in the water
• I understand Wake Bros LLC is not responsible for lost or damaged personal items
• I agree to be financially responsible for any damage to provided equipment caused by misuse or negligence

5. Infant and child safety notice

Wake Bros LLC is not trained or responsible for sizing or providing child/infant life vests. It is the responsibility of the parent or guardian of the minor to ensure the minor has the appropriate life vest to board the water craft.

Children under 12 are required by Montana law to wear life jackets while on board.

6. No alcohol provided

Wake Bros LLC does not provide or sell alcoholic beverages.

Participants who choose to consume alcohol are solely responsible for their actions and behavior while aboard. Intoxicated guests may be denied participation without refund.

7. Medical condition & emergency authorization

I certify that I do not have any medical condition that would prevent me from safely participating. I authorize Wake Bros LLC staff to obtain emergency medical treatment on my behalf if necessary.

8. Photography waiver

I grant permission for Wake Bros LLC to use photographs or videos taken during the charter for promotional or social media purposes.

9. Governing law

This release shall be governed by the laws of the State of Montana, and any disputes will be resolved in Montana courts with venue in the county of operation.
